Golden Visa Portugal: Investment Funds (CMVM) — Complete Guide 2026

Why investment funds became the dominant Golden Visa route

Until 2023, the vast majority of Golden Visa applicants chose real estate. When that route was closed by the More Housing Law (Lei n.º 56/2023), CMVM-regulated investment funds became the primary qualifying option. Today they account for the large majority of new applications submitted to AIMA.

The shift brought a new set of questions that many applicants — and even some lawyers — are still navigating: Which funds actually qualify? What does the CMVM registration mean in practice? Can the €500,000 ever be recovered? And what are the real risks involved?

This guide answers all of those questions using current AIMA rules, CMVM registration requirements, and verified fund documentation.

What the law requires: the legal framework

The Golden Visa fund route is governed by Article 3(1)(d) of Law n.º 23/2007 (amended by Law n.º 56/2023) and the implementing regulation Portaria n.º 306-A/2015. The requirements are:

  • The fund must be registered and supervised by the CMVM (Portugal's securities market regulator)
  • It must be structured as a venture capital fund (fundo de capital de risco) or private equity fund (fundo de private equity) under Portuguese law
  • The fund's own documentation must include a clause explicitly stating its eligibility for the Golden Visa program (often referred to informally as "AIMA eligibility")
  • The minimum subscription is €500,000 per applicant (the main applicant only; dependants do not require additional investment)
  • The investment must be maintained for the duration of the Golden Visa's validity and renewal cycles — in practice, approximately five years from the date of permit issuance

Important distinction: CMVM registration confirms that a fund meets Portuguese regulatory requirements for capital markets. It does not, by itself, confirm that a fund is eligible for the Golden Visa program. That confirmation must come from the fund's own prospectus and, ultimately, from AIMA's approval of each individual application.

How the holding period actually works

This is one of the most misunderstood aspects of the fund route, and getting it wrong creates serious financial planning problems.

The five-year holding period does not begin from the date of investment. It begins from the date AIMA issues the Golden Visa residence permit. The investment must be made before the application is submitted, and AIMA processing currently takes between 12 and 18 months. The realistic total commitment timeline, from the moment you transfer the €500,000 to the moment you are legally permitted to redeem it, is therefore approximately 6.5 years in most cases — and potentially longer depending on processing delays and renewal timing.

Applicants who plan their exit timeline based on the fund's own five-year closed-end structure (which runs from the date of the fund's own launch, not from the GV grant date) sometimes find that the two clocks are misaligned — creating situations where the fund is ready to distribute before the holding period for Golden Visa purposes has elapsed.

What CMVM registration means — and what it doesn't

The CMVM maintains a public registry of all authorised collective investment undertakings in Portugal. A fund appearing on that registry confirms that it was legally constituted under Portuguese law, that its management company is authorised, and that it complies with ongoing reporting and disclosure obligations.

It does not confirm:

  • That the fund is still accepting new subscriptions from Golden Visa applicants
  • That the fund's investment strategy will preserve capital
  • That AIMA will accept applications citing that fund
  • That the fund will generate positive returns

Approximately 36 funds verifiably meet all criteria for the Golden Visa fund route as of 2026 — a figure significantly lower than the "50+ eligible funds" commonly cited in marketing materials. Of those, only a subset explicitly state their Golden Visa eligibility in their publicly available prospectus documentation.

How to verify a fund's eligibility before investing

Before committing €500,000, verify each of the following independently:

  1. Confirm the fund appears in the CMVM public registry at cmvm.pt
  2. Obtain and read the fund's current prospectus — look specifically for language confirming Golden Visa programme eligibility
  3. Confirm with the fund's management company in writing that the fund is currently accepting Golden Visa subscriptions
  4. Have a lawyer review the subscription documentation before signing
  5. Confirm with your lawyer that AIMA has approved prior applications citing the same fund

Tax considerations for fund investors

Non-resident investors in Portuguese investment funds are subject to withholding tax on distributions. The applicable rate depends on the investor's country of residence and any applicable double taxation agreement between Portugal and that country. Some applicants choose to establish Portuguese tax residency through the NHR (Non-Habitual Resident) regime or its successor to optimise their tax position — but this has its own requirements and implications that must be evaluated separately with a tax adviser.

Choosing a fund: what matters

With approximately 36 qualifying funds available, the selection process deserves as much attention as the legal compliance verification. Key factors to assess include the fund management team's track record, the sectors and geographies in which the fund invests, the fund's size and capitalisation, the liquidity provisions at maturity, the fee structure (management fees, performance fees, entry and exit costs), and the historical performance of prior vintages managed by the same team.

BBA Law does not recommend specific funds, manage investments, or receive commissions from fund managers. Fund selection should be made with the advice of a qualified financial adviser who has reviewed the full prospectus documentation.
